Terms and Conditions

1. Acceptance
By accessing or using Tulu Marketplace, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the platform.
2. Platform Role
Tulu Marketplace is an intermediary that displays third-party dealer inventory and connects vehicle buyers with dealerships and Tulu sales representatives. Tulu does not own, sell, or warrant the vehicles listed on the platform.
3. Vehicle Information Disclaimer
Vehicle listings originate from dealerships and may be inaccurate, incomplete, or out of date. You should verify all details including price, mileage, condition, equipment, and vehicle history directly with the dealership before making any purchase decision.
4. Pricing and Availability
Prices and vehicle availability displayed on the platform are not guaranteed and may change without notice. Taxes, fees, and financing terms are determined by the dealerships and are not set or controlled by Tulu.
5. Dealership Responsibility
The dealership is the seller and is solely responsible for the vehicle, the sale, any financing arrangements it offers, and all post-sale obligations including warranty and service commitments.
6. Tulu Sales Reps
Tulu sales representatives may assist you in comparing vehicles and coordinating introductions with dealerships. They do not act as agents of any dealership and do not warrant or guarantee any inventory or transaction outcome.
7. Lead Forms and Communications
By submitting a lead form or inquiry, you consent to Tulu and the relevant dealership contacting you regarding your inquiry. You may opt out of future communications at any time by following the instructions in those messages.
8. Future Financing
Any financing tools or third-party financing partners surfaced on the platform in the future will be subject to their own terms and conditions. Tulu is not a lender and does not provide or guarantee financing.
9. No Warranties
The platform is provided "as is" and "as available" without any warranties of any kind, whether express or implied, to the fullest extent permitted by law.
10. Limitation of Liability
Tulu is not liable for any indirect, incidental, or consequential damages arising from your use of the platform or any vehicle transaction. To the extent permitted by law, our total liability is limited to CAD $100.
11. User Conduct
You agree not to scrape, crawl, or extract data from the platform outside of permitted use, not to abuse or disrupt the service, and not to impersonate any person or entity.
12. Intellectual Property
Tulu branding, design, and platform code are owned by Tulu. Dealership images, logos, and vehicle content remain the property of their respective owners.
13. Termination
Tulu may suspend or terminate accounts that violate these Terms at our sole discretion, with or without notice.
14. Governing Law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, subject to any mandatory consumer protection legislation that may apply to you.
15. Changes
We may update these Terms from time to time. Continued use of the platform after changes are posted constitutes acceptance of the revised Terms.
